Terms of Service for Zap

Effective Date: November 19, 2025

1. Acceptance of Terms

Ventana Tools LLC ("Ventana", "we", "us", or "our") provides the Zap image compression application ("Zap", "Service", or "Software") as a free software product. By installing, accessing, or using Zap, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use Zap.

2. License and Access

Subject to these Terms, Ventana grants you a free, non-exclusive, non-transferable, revocable license to use Zap for your personal or business purposes on Windows operating systems. This license is provided at no cost and allows for use of Zap on any number of Windows devices that you own or control.

Free Software: Zap is provided free of charge. There are no purchase fees, subscription costs, or hidden charges. However, this does not grant you ownership of the software or the right to redistribute it as a paid product.

3. Use Restrictions

You may not:

  • Copy, modify, distribute, sell, or lease any part of our Software or included documentation.
  • Reverse engineer or attempt to extract the source code of the Software, unless laws prohibit these restrictions or you have our written permission to do so.
  • Use Zap in ways that infringe intellectual property rights or violate applicable laws.
  • Redistribute Zap as a paid product or bundle it with other software for commercial gain.

4. Intellectual Property

All rights, title, and interest in and to Zap (excluding content provided by users) are and will remain the exclusive property of Ventana Tools LLC and its licensors. The terms of this license do not transfer any ownership rights of the Software to you.

5. Updates and Maintenance

Ventana may from time to time provide updates or enhancements to Zap. These updates may include bug fixes, feature enhancements, or improvements. Zap includes an automatic update mechanism. By using Zap, you consent to the download and installation of updates. The terms of this license will govern any updates provided by Ventana that replace and/or supplement the original Software, unless such update is accompanied by a separate license in which case the terms of that license will prevail.

6. File Handling and Data Responsibility

Important: Zap can permanently modify or overwrite image files when used in "in-place" mode. You are solely responsible for:

  • Backing up your images before using Zap
  • Ensuring you have appropriate rights to modify the files you process
  • Verifying the results of image compression meet your requirements
  • Recovering from any data loss that may occur during optimization

Ventana is not responsible for any loss, corruption, or permanent deletion of image files or other data resulting from your use of Zap.

7. Disclaimers

Zap is provided on an "as is" and "as available" basis. Ventana does not guarantee that the Software will function uninterrupted or be error-free, and you use it at your own risk. Compression results may vary, and some optimizations may result in larger files or degraded quality. Ventana makes no warranties regarding compression ratios, quality retention, or compatibility with all image formats.

8. Limitation of Liability

To the extent not prohibited by law, in no event will Ventana be liable for any indirect, incidental, special, consequential or punitive damages resulting from your use of or inability to use Zap, including but not limited to loss of data, loss of profits, or business interruption, even if Ventana has been advised of the possibility of such damages.

9. Third-Party Components

Zap incorporates open-source libraries and components. A complete list of third-party components and their licenses is available in the Third-Party Notices. You agree to abide by the terms of these third-party licenses.

10. Termination

Ventana may terminate this license at any time if you fail to comply with these Terms. Upon termination, you must cease all use of the Software and delete all copies of Zap from your devices.

11. Changes to Terms

Ventana reserves the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Software after those revisions become effective, you agree to be bound by the revised terms.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Delaware.
