Terms of Service for FontPilot

Effective Date: September 17, 2025

1. Acceptance of Terms

Ventana Tools LLC ("Ventana", "we", "us", or "our") provides the FontPilot font management application ("FontPilot", "Service", or "Software"), which is distributed through the Microsoft Store. By installing, accessing, or using FontPilot, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use FontPilot.

2. License and Access

Subject to these Terms, Ventana Tools LLC ("Ventana") grants you a non-exclusive, non-transferable, revocable license to use FontPilot, a font management application ("FontPilot" or "Software"), for your personal or business purposes on a Windows operating system. This license is granted for a one-time purchase fee and allows for perpetual use of the version of FontPilot you have purchased.

License Requirements: Each license purchased is valid for use by one individual only. Sharing a license with others (including but not limited to co-workers, team members, or any other person) is strictly prohibited and may result in the termination of your license—without refund. Additional individuals or teams will require their own separate licenses.

Future versions or upgrades, such as "FontPilot 2," may require the purchase of a new license.

3. Payment and Transactions

All payment and transaction processes for FontPilot are facilitated through our third-party payment gateway, Lemon Squeezy, which acts as our merchant of record. By purchasing FontPilot, you agree that you are also bound by Lemon Squeezy's Terms of Service.

Refunds: Refunds are handled directly by Lemon Squeezy and are provided at their sole discretion on a case-by-case basis. Lemon Squeezy may refuse a refund request in cases of fraud, refund abuse, or other manipulative behaviors.

Despite the above, your statutory rights as a consumer are not affected. You retain rights in relation to products that are not as described, faulty, or not fit for purpose. Please refer to Lemon Squeezy's terms of service for detailed information on their refund practices and your rights as a consumer.

4. Use Restrictions

You may not:

Copy, modify, distribute, sell, or lease any part of our Software or included documentation.
Reverse engineer or attempt to extract the source code of the Software, unless laws prohibit these restrictions or you have our written permission to do so.
Bypass or break any security mechanisms implemented by FontPilot or Paddle that restrict how the Software may be used.
Abuse or fraudulently use licensing mechanisms, including (but not limited to) sharing, selling, or transferring licenses in ways not permitted by these Terms.

5. Intellectual Property

All rights, title, and interest in and to FontPilot (excluding content provided by users and system installed fonts) are and will remain the exclusive property of Ventana Tools LLC and its licensors. The terms of this license do not transfer any ownership rights of the Software to you.

6. Updates and Maintenance

Ventana may from time to time provide updates or enhancements to FontPilot, available through the Microsoft Store. These updates may include bug fixes, feature enhancements, or improvements. The terms of this license will govern any updates provided by Ventana that replace and/or supplement the original Software, unless such update is accompanied by a separate license in which case the terms of that license will prevail.

7. Disclaimers

FontPilot is provided on an "as is" and "as available" basis. Ventana does not guarantee that the Software will function uninterrupted or be error-free, and you use it at your own risk.

8. Limitation of Liability

To the extent not prohibited by law, in no event will Ventana be liable for any indirect, incidental, special, consequential or punitive damages resulting from your use of or inability to use FontPilot, even if Ventana has been advised of the possibility of such damages.

9. Font Licensing Responsibility

Ventana does not provide licenses for any fonts. Users of FontPilot are solely responsible for ensuring that they have the appropriate licenses for all fonts they import and use within the Software. This includes system fonts that are pre-installed with your operating system, which are subject to the licensing terms set by the operating system provider. It is the user's responsibility to ensure that they are in compliance with the terms and conditions of any font licenses they may have acquired from third-party providers. Ventana disclaims all liability for any illegal use of fonts by users and any legal consequences that may arise from such use.

10. Termination

Ventana may terminate this license at any time if you fail to comply with these Terms. Upon termination, you must cease all use of the Software and delete all copies of FontPilot from your devices.

11. Changes to Terms

Ventana reserves the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Software after those revisions become effective, you agree to be bound by the revised terms.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State where Ventana Tools LLC is registered, without regard to its conflict of law provisions.
